The Email Workflow for Wedding Photographers

Please read the Terms of Use for the Email Workflow for Wedding Photographers (hereinafter referred to as the “Workflow”) carefully and in their entirety before purchasing and using the Workflow. The Workflow and its content are owned by Hannah Rosser Photography LLC.

Definitions:
“Company,” “We,” “I,” “Our,” or “Us” means Hannah Rosser Photography LLC.
“Participation,” “Participating,” “Using,” or “Use” means reading, implementing, copying, or otherwise engaging in the Workflow.
“You” or “Your” means the purchaser and person using the Workflow.
Consent:
By using the Workflow, you implicitly and voluntarily agree to act in accordance with, agree to, and abide by these Terms of Use.
DISCLAIMER:
By using the Workflow, you understand that Hannah Rosser is a photographer and business mentor. The Workflow is for informational and educational purposes only. The information and education provided in this Workflow are not intended or implied to supplement or replace the professional advice of an attorney, accountant, or financial advisor. You should consult with a professional in those areas (financial, legal, accounting, etc.) in person, where you live or work, to discuss issues or questions pertaining to your particular legal, financial, or business situation.
Although we strive to ensure all content in the Workflow is up to date and accurate, we do not make any representation that all the information is free of errors at all times. We do not assume any responsibility for the accuracy of the Workflow's information, or its safety or efficacy as it applies to you.
Assumption of the Risk:
You should use your best judgment when using the information provided in the Workflow, which is done at your own risk. It is your responsibility to assess the risks of using the Workflow or its content. You assume responsibility for your actions, choices, or lack thereof, related to the Workflow.
Intellectual Property Ownership:
The Workflow and its content, including, but not limited to, email templates, instructional materials, design, and structure, are intellectual property owned by Hannah Rosser and Hannah Rosser Photography LLC. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.
No Sharing:
You cannot distribute, forward, or share the Workflow, its content, or the download link with anyone else. This includes, but is not limited to, sharing via email, social media, or any other method. Any violations of these Terms of Use will be legally pursued to the fullest extent permitted by law.
Permitted Use:
You are permitted to use the email templates within the Workflow in your own communications with clients only. You may not distribute, share, or sell these email templates to others.
No Claims Made Regarding Results:
Any testimonials or examples used by us are simply that—examples. They are not guarantees that you will experience or receive the same results. The Workflow does not guarantee client bookings, income goals, or financial outcomes. We do not make any assurances regarding email open rates, client reviews, or other results based on your use of the Workflow.
No Warranties, Guarantees, or Representations Are Being Made:
We do not offer any representations, guarantees, or warranties of any kind regarding the Workflow, including but not limited to future income, bookings, or success. The Workflow is offered “AS IS” and without warranties or guarantees of any kind, express or implied. We are not liable for damages of any kind related to your use of the Workflow.
Your Release of Us, Indemnification, Hold Harmless:
To the fullest extent permitted by law, Hannah Rosser Photography LLC expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of the Workflow, its materials, our website, or any other information obtained by you from us. By purchasing the Workflow, you hereby agree to this limitation of liability and release Hannah Rosser Photography LLC from any and all claims.
You agree to defend, indemnify, and hold harmless Hannah Rosser Photography LLC, its subsidiaries, employees, agents, contractors, subcontractors, shareholders, and affiliates from any claims, suits, actions, or damages related to your purchase or use of the Workflow.
Refund Policy:
Due to the digital nature of the Workflow, refunds will not be issued under any circumstances. Once the Workflow is purchased, it is a final sale. The product is made available for immediate download, and therefore, we cannot offer any refunds. If you have any questions or concerns, or if there is anything we can do to make your experience a more pleasant one, please email Hannah at hello@hannahrosser.com.
Arbitration Clause:
If you have any complaint or issue with the Workflow, please contact us directly first at hello@hannahrosser.com.
If we are unable to resolve your dispute, you agree that the dispute will be submitted to binding arbitration with the American Arbitration Association, before an arbitrator mutually agreed upon, in accordance with AAA’s rules. Arbitration will be held within 50 miles of Raleigh, North Carolina. You waive your right to a jury trial in court and agree that any award issued will be binding. The only award available to you is a refund of the purchase price, and no consequential or punitive damages will be awarded.
Limitation of Liability:
Hannah Rosser and Hannah Rosser Photography LLC are not responsible or liable for any damages incurred directly or indirectly from your use of the Workflow. This includes, but is not limited to, misuse of the Workflow, failure to follow instructions, or any damages caused by your own actions.
IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
Payment and Purchase Terms:
By purchasing the Workflow, you authorize Hannah Rosser Photography LLC to charge your credit or debit card for the amount owed. Your payment information may be processed by third-party merchants like PayPal, Stripe, or Shop, who have their own privacy policies. Hannah Rosser Photography LLC is not responsible for these merchant’s practices.
Severability:
If any part of these Terms of Use is found to be illegal, invalid, or unenforceable, it will not affect the enforceability of the remaining provisions.
Entire Agreement:
These Terms of Use constitute the entire agreement between you and the Company, superseding all prior agreements.
Choice of Law and Venue:
These Terms of Use are governed by the laws of the state of North Carolina. Any dispute arising from these Terms must be brought in the courts of Wake County, North Carolina.
By purchasing and/or using the Workflow, you implicitly agree to all terms outlined in these Terms of Use.
